Engage (“Service”) is offered by Route Ignite Solutions Pvt. Ltd. By using Engage, you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Route Ignite Solutions reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. ACCOUNT TERMS

  • You must be 13 years or older to use this Service.
  • You must be a human. Accounts registered by “bots” or other automated methods are not permitted. Account creators may be representatives of corporations or other entities.
  • You must provide your legal full name, a valid email address, and any other information requested in order to complete the sign-up process.
  • You are responsible for maintaining the security of your account, password, and private key (used for API access). Engage cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You are responsible for all content that is distributed under your account.
  • Engage cannot and will not be liable for any injury, loss, or damage from the delivery failure, receive failure on a mobile device, or failure of a user to act on any notification.
  • One person or legal entity may not maintain more than one account with free tier usage.
  • You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Violation of any of these agreements will result in the termination of your Account. While Engage prohibits such conduct and content on the Service, you understand and agree that Engage cannot be responsible for the content sent through the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

MODIFICATIONS TO THE SERVICE AND PRICES

  • Engage reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Prices of all Services are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Engage site (engage.ninja). Engage shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

COPYRIGHT AND CONTENT OWNERSHIP

  • We claim no intellectual property rights over the material you provide to the Service.
  • Engage does not pre-screen content, but Engage and its designee have the right (but not the obligation) in their sole discretion to refuse access to the Service.
  • Payment and/or use of the service only entitles you to the use of the service, all copyrights, including source code and binary compilations, owned by Engage are not transferred under any circumstances.

GENERAL CONDITIONS

  • Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.
  • You understand that Engage uses third party vendors and hosting partners to provide the necessary hardware, software, networking, and related technology required to run the Service.
  • You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Services or any other Engage service.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Engage.
  • We may, but have no obligation to, suspend or delete Accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
  • Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Engage customer, employee, member, or officer will result in immediate account termination.
  • You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve
    (a) transmissions over various networks; and
    (b) changes to conform and adapt to technical requirements of connecting networks or devices.
  • Engage does not warrant that
    (i) the service will meet your specific requirements,
    (ii) the service will be uninterrupted, timely, secure, or error-free,
    (iii) the results that may be obtained from the use of the service will be accurate or reliable,
    (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and
    (v) any errors in the Service will be corrected.
  • You expressly understand and agree that Engage shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Engage has been advised of the possibility of such damages), resulting from:
    (i) the use or the inability to use the service;
    (ii) unauthorized access to or alteration of your transmissions or data;
    (iii) statements or conduct of any third party on the service;
    (iv) termination of your account; or
    (v) any other matter relating to the service.
  • The failure of Engage to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Engage and govern your use of the Service, superseding any prior agreements between you and Engage (including, but not limited to, any prior versions of the Terms of Service).

Privacy policy

By using Engage (“Service”), you are agreeing to be bound by the following privacy policy (“Privacy Policy”). Engage reserves the right to update and change the Privacy Policy from time to time without notice.

We collect the e-mail addresses of those who communicate with us via e-mail and sign up for services, aggregate information on what pages consumers access or visit, aggregate information on service usage, and information volunteered by the customer. The information we collect is used to improve the content of our website, improve our products, and the quality of our service.

It is not shared with or sold to other organizations for commercial purposes, except under the following circumstances:

It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms of Service, or as otherwise required by law.

We will transfer information about you if Engage is acquired by or merged with another company.

INFORMATION GATHERING & USAGE

  • When you register with Engage we ask for information such as your name, email address, billing address, credit card information. (Customers who sign up are not required to enter a credit card for use of the free tier.)
  • Engage uses collected information for the following general purposes: products and services provisioning, billing, notification targeting, identification and authentication, services improvement, contact, and research.
  • Engage may use aggregated sets of collected information for the following general purposes: marketing, notification targeting, public relations, and research.

COOKIES

  • A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a website’s computers and stored on your computer’s hard drive.
  • Cookies are required to use the Engage websites.
  • We use cookies to record current session information.
  • Cookies owned/set by Engage are not shared with third parties.

DATA STORAGE

Engage uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate Engage. Although Engage owns the code, databases, and all rights to the Engage application. You retain the copyright to your content.

DISCLOSURE

Engage may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service.

Engage has committed to refer unresolved privacy complaints under the US-EU and US-Swiss Safe Harbor Principles to an independent dispute resolution mechanism, the BBB EU SAFE HARBOR, operated by the Council of Better Business Bureaus. CHANGES

Engage may periodically update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the email address you use to sign in to any of our products.

Cancellation policy

  1. You can cancel your Engage subscription any time from the admin dashboard. Your account will be active and all features will be accessible until the end of current billing cycle.
  2. Active subscriptions get renewed automatically at the end of each month.
  3. If you stop using our services in between the term, we will not refund you the fees paid by you for the remaining term.
  4. We reserve the right to modify or terminate the Engage service(s) for any reason, without notice at any time.
  5. Fraud: Without limiting any other remedies, Engage may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or investigation, or otherwise, forcefully removed our branding) have engaged in fraudulent activity in connection with the services offered by us.
  6. Note: No refunds are offered, even if a plan is canceled mid-month.

30 days trial period

First time users get a 30 days free trial of all features. No credit card is required for signup. After 30 days, you need to signup for one of the plan to continue using our service. Engage will also not honor a free trial period for customers who were once paying subscribers, cancelled, and then decided to re-instate their subscription to Engage.

Monthly Billing, Cancellation, and Refund Policies

Engage charges and collects in advance for use of the service. All services rendered are non-refundable. Once a customer selects a subscription plan and provides billing information, Engage will calculate a pro-rated amount with the first payment due after trial period.

All subscriptions monthly, quarterly and yearly renew automatically on their due renewal date according to date of purchase until officially cancelled via admin dashboard. Customers may cancel anytime.

Customers will receive an email from Engage confirming that their subscription to the service has been cancelled.

Important: No refunds or credits for partial months, quarters or years of service will be refunded to a customer upon cancellation.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and the customer is responsible for payments of all such taxes, levies, or duties.

The fees that Engage charges for the monthly, quarterly, or yearly services exclude phone, and Internet access charges, as well as other data transmission charges. Any currency exchange settlements are based on the customer's agreement with the payment method provider. To be clear: these charges are the customer's responsibility.

Customers have the ability to upgrade or downgrade their subscription plan for the services at any time. Customer can upgrade or downgrade subscription via admin dashboard.

The chosen method of billing will automatically be charged the new subscription rate on the next billing cycle.

With regards to downgrades on a subscription, Engage does not issue refunds or credits for partial months of service.

Engage reserves the right to refuse/cancel a subscription to any of the services bought from engage.ninja

These above policies apply to all the services listed on Engage unless otherwise noted.
